Lucan Group means Lucan Group Pty Ltd (ABN 83 132 645 722)

The Person means any business, company, trust or any commercial enterprise;

The Applicant means any employee, candidate, contractor or job applicant;

Any One means the applicant or person;

Third Party means any other person


Lucan Group Pty Ltd (Lucan Group) is bound by the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).  This Privacy Policy details how Lucan Group generally collects, holds, uses and discloses personal information and any one’s rights in relation to the personal information that it holds.  It contains information about how you may access the personal information that Lucan Group holds and seek the correction of such information.  It also contains information about how you may complain about an alleged breach of the APPs and how Lucan Group will deal with such a complaint.

Collecting Personal Information

The personal information Lucan Group may collect will depend on the circumstances of collection, including whether we collect the information from an employee, client, supplier, contractor or job applicant, third party or any one. The type of personal information which Lucan Group collects about any one depends on the nature of the person’s dealings with us. We only collect personal information that is necessary or required by law so as to deliver our services, including the hiring of consultants, recruitment activities, consulting, training, or for administration purposes including but not limited to, invoicing and networking.

Keeping Information Accurate, Complete and Up to Date:

While keeping in mind why the information is being collected, Lucan Group takes reasonable steps to make sure that the information is accurate, complete and up-to-date at the time of collection and when used or disclosed.

The Client (“Person”):

When a Person requests our services as a client, Lucan Group typically collects the following personal information about you:  your ABN and ACN, full name, street address, telephone number, email address, working visa, opinions and other information that maybe used to assist us in providing our recruitment and/or consulting services.

Employee’s, Applicants and Contractor’s (“Applicant’s”):

Lucan Group also collects from Applicants personal information provided in resumes such as references, education, employment qualifications and competencies.  In most cases, we collect personal information about an Applicant directly from the Applicant in the following ways, in person, by telephone, letter and/or via electronic means, we can, on completion of the Applicant filling out application forms, collect further information from social media platforms, such as LinkedIn but not limited to LinkedIn.  On request, Information is also collected from other parties, for example, government agencies, publicly available records, service providers such as on-line searches, parties to whom the Applicant refers Lucan Group or from whom the Applicant authorises collection of data about them, to be passed onto Lucan Group.

Information Collected:

Lucan Group may; collect and hold the following kinds of personal information about Person’s, Applicant’s and third parties:

  1. full name, job title, business contact details of company representatives with whom Lucan Group deals, financial information, banking details; and
  2. in the context of its recruitment process for its own employees and contractors, may collect and hold the following kinds of personal information: full name, date of birth, address telephone number, and email address, marital status, financial details (including banking details), citizenship, employment references, civil, credit and criminal records, driver’s licence information, education, employment history, membership of any professional or trade association, health information and a complete history of communications with the Person or Applicant, or any other person concerned with the business of Lucan Group.

Personal information will not knowingly be collected from a minor without his or her parent’s consent.  Meaning, Lucan Group cannot be absolutely sure of the true age of any one it communicates with via email, telephone or social media platforms.

Sensitive Information:

Lucan Group will not knowingly ask anyone to provide sensitive personal information in a place where other people can overhear. Where personal information is sensitive information, Lucan Group will only collect that information where:

  • It is reasonably necessary for one or more of Lucan Groups work functions or activities; and
  • The Applicant or Person consents to the collection of the information; or
  • Lucan Group is required or authorised by law to collect the sensitive information

If Lucan Group receives personal information that it did not solicit from an Applicant or Person and if Lucan Group determines that it could not have lawfully collected that information as part of its work functions or activities, then Lucan Group will (if it is lawful and reasonable), notify you and if deemed necessary and lawful will destroy the information or ensure that it is de-identified.

 Using and Disclosing Personal Information

Lucan Group recognises the trust that Applicant’s and Person’s place in the organisation when they give us personal information. Lucan Group collects, holds, uses and discloses an Applicant’s personal information for the purposes of providing business services to the Applicant.  Lucan Group may also use and disclose the personal information for related purposes and other purposes, including to maintain, manage and develop our relationship with anyone, so as to comply with our legal and regulatory obligations, to contract out some of our work activities to external service providers and suppliers, to assess and consider applications from prospective job applicants, contractors and service providers and for such purposes for which Lucan Group will obtain consent from you from time to time. In order to deliver a requested service, we may sometimes share your personal information with an affiliate (including a selected training company) and potential employers. We may also disclose your personal information to other third parties and for other purposes with your consent.  That consent may be written, including email or verbally, by way of telephone, which conversations will be noted in Lucan Groups database. In some circumstances and with your consent, personal information may be disclosed to third parties in jurisdictions including the United States of America, the United Kingdom, New Zealand, Singapore and Hong Kong.

Declining Services

If you do not provide the personal information we request or consent to the collection and use of your personal information for the purposes outlined in this Privacy Policy, Lucan Group may not be able to assist you in providing the services outlined above.

Lucan Group may also deny access to some information (provided by you) requested by you, as providing such access could have an unreasonable impact upon the privacy of other individuals.

Data Security

Lucan Group will endeavour to take all reasonable steps to protect personal information that it holds from unauthorised access, modification, misuse, interference and loss. When any personal information supplied is no longer required it is kept secure and our employees and data processors are instructed and obliged to respect the confidentiality of any one’s personal information held by Lucan Group.

However, Lucan Group will not be held responsible for events arising from unauthorised access to your personal information.

Access and Correction

Personal information that is collected is available for access by you and correction by you at any time. Subject to any exceptions contained in the Privacy Act to the contrary, you have a right to have access to the information that we hold about you on record.

You can also request amendments to your records should you believe that they contain inaccurate information. We will allow access or make the requested changes at your request unless there is a reason under the Privacy Act 1988 (Cth) or other relevant law to refuse such access, if this is the case we reserve the right to refuse to make the requested changes. If we do not agree to change your record/personal information in accordance with your request, you may write a detailed a statement of the proposed requested changes and we will enclose this with your record. Further should you wish to then obtain access to your records your request should be in writing, out line in detail the information you are seeking. Please note we may recover reasonable costs associated with supplying this information to you.

Before access to personal information is granted to any individual their identity needs to be established. The individual is required to request the information in person with photographic ID or to provide personal details that can be used to identify them.


(a) you have questions or comments about this Privacy Policy;

(b) we have reason to deny you access to your personal information; or

(c) you have a complaint about our information handling practices,

Trans border Data Flow

Lucan Group will only transfer personal information outside Australia at the request or consent of the Applicant and if Lucan Group has reason to believe the information will be granted a similar level of protection under the Privacy Act 1988 (Cth).


  • This is to confirm that I understand and agree that the information I have provided with at interview, to Lucan Group, will be used to assess my suitability for employment for the position in question or other positions that arise that in the opinion of Lucan Group may fit my capabilities and qualifications as listed in my resume.
  • I understand and give my permission to Lucan Group that the information contained in my resume or from interview notes, psychological assessment as well as referee comments, can and/or may be conveyed to prospective employers.
  • I also understand and require that I will be notified before my information is passed to a prospective employer other than the position(s) to which I have applied in this instance.
  • I give permission for my information to be retained by Lucan Group for consideration for future positions.
  • I understand that referees I have provided or will provide may be contacted and information provided by those referees may be used to assist in assessing my suitability for this or other positions.
  • I consent to Lucan Group passing onto any prospective employer information given to Lucan Group by any referee I have provided.
  • I consent to Lucan Group collecting my sensitive information where necessary.
  • I accept that any information may be transferred overseas for the purpose of seeking a position this will only be done with my knowledge and consent. I acknowledge that, by consenting to Lucan Group disclosing my personal information to overseas recipients, Australian Privacy Principle 8.1 will not apply to the disclosure and as a result Lucan Group will not be accountable under the Privacy Act and I may not be able to seek redress under the Privacy Act in respect of the personal information so disclosed.
  • I declare that I have valid Australian work rights and/or the appropriate visa to legally work in Australia. Should there be any changes to this I will inform Lucan Group immediately and within seven (7) days of this information being received by me.
